I. ORGANIZATIONAL STRUCTURE OF THE DISTRICT PEOPLE’S COMMITTEE

According to Charter 2, Part 2, Article 27 of the Law No 77/2015/QH13 of the National Assemble of Vietnam dated 19 June 2015 on organizing local government, the organizational structure of the district-level people’s committee is regulated as follow:

1. A district people committee includes one Chairperson, vice Chairpersons and members

People’s Committee of type I districts is regulated to have no more than 3 Vice Chairpersons while that of type II and III have no more than 2 Vice Chairpersons.

Members of the district People’s Committee include those who are head of the specialized agencies under the district People’s Committee, the members in charge of military and the members in charge of public security.

2. The specialized agencies under the district People’s Committee are divisions and relevant agencies.

II. TASKS AND POWER OF THE DISTRICT PEOPLE’S COMMITTEE

According to Charter 2, Part 2, Article 28, of the Law No 77/2015/QH13 of the National Assemble of Vietnam dated 19 June 2015 on organizing local government, the tasks and power of the district-level people’s committee are stipulated as follow:

1. Build and submit the district People’s Council to decide the contents as per stipulated at points a, b, c and g, clause 1, clause 2 and clause 3, article 26 of this Law and implement the resolutions of the district People’s Council.

2. Regulate the apparatus organization, detailed tasks and authority of the specialized agencies under the district People’s Committee.

3. Execute the district’s budget, carry out the tasks on socio-economic development, industrial development, construction, trade, service, tourism, agriculture, forestry, fishery, traffic network, irrigation, building rural residential areas, land management and use, forest, lakes and rivers, water resources, mineral resources, ocean resources and other natural resources and environment protection in the district in accordance with law.

4. Perform duties to organization and guarantee of the enforcement of the Constitution and legislation, and government construction, administrative division, education, training, science, technology, culture, information, physical activities, sports, healthcare, labor, social policies, ethnic and religion affairs, national defence, security, social order and safety, justice administration, justice assistance as well as other duties, and exercise other powers in accordance with laws.

5. Implement tasks, duties and authorities decentralized and authorized by senior-level state agencies.

6. Assign and authorize communal people’s committee and other agencies and organizations to implement the duties and authorities of the district People’s Committee.

III. ASSIGNMENTs, POWER AND WORK RELATIONSHIP AMONG CHAIRPERSON AND VICE CHAIRPERSONS OF THE DISTRICT PEOPLE’S COMMITTEE

* Principles of assignments and work relationship among Chairperson, Vice Chairpersons and members of the district People’s Committee

1. Chairperson of the district People’s Committee (hereinafter referred as Chairperson) leads and direct tasks of the district-level People’s Committee and has responsibility to perform the tasks as per stipulated at the Article 29 of the Law on organizing local government dated 19 June 2015 and other issues in accordance with law.

Chairperson shall assign taks and duties for Vice Chairpersons of the district People’s Committee (hereinafter called Vice Chairperson) to help the Chairperson to supervice, direct and handle regular works under the power of the Chairperson in each field of the district People’s Committee.

2. Vice Chairpersons shall perform the tasks and duties delegated by the Chairperson and bear responsibilities before the district People’s Council, People’s Committee and Chairperson of the district People’s Committee while sharing collective responsibilities for the performance of the district People’s Committee before the district Party Committee, People’s Council, People’s Committee and Chairperson of the district People’s Committee.

The Vice Chairpersons shall take initiative in handling and deciding the issues within the fields of their assignments, timely report and ask for opinions of the Chairperson upon complicated and important issues before making decisions. Besides, the Vice Chairperson shall collaborate with other Vice Chairpersons to handle related issues. In case of differential opinions among the vice chairpersons, the vice chairperson in charge of that issue shall ask for opinions of the Chairperson. Araising issues or those beyond their jurisdiction shall be reported to the Chairperson for decision. If the issue is under jurisdiction of the district People’s Committee, it shall be raised at the meeting of the district People’s Committee for discussion and decision.

Within their assigned tasks, the vice chairpersons shall be delegated as power of the Chairperson to handle the problems and bear responsibilities before the law on performing their assignments, particularly:

(1) Directing implementation of the master plans and projects within the fields of their jurisdiction conforming to the resolutions of the district People’s Council, directives of the district People’s Committee, sector planning and master plans of the upper-level state agencies, guidelines and policies of the Communist Party and State; formulating mechanism, policies and legal documents for issuance by relavant authority.

(2) Regularly inspecting, accelerating, guiding and directing the agencies under the district People’s Committee and the communes and towns in implementing the guidelines and policies of the state, resolutions of the district People’s Council, directives of the district People’s Committee and Chairperson of the district People’s Committee to perform their tasks and duties.

 (3) Dealing with the issues in need of inter-agency collaboration and respond to recommendations of the agencies and people’s committee of the communes and towns under jurisdiction of the Chairperson within the scope of their assignments.

(4) Supervising and directing implementation of the projects within the fields of their jurisdiction from issuance of investment policies to completion of the projects and execution of the budget estimate the fields of their management.

 (5) Supervising and directing performances of the agencies and units under their management and bear responsibilities before the district People’s Committee and Chairperson of the district People’s Committee if one of the agencies and units, people’s committee of the communes and towns under their management fails to fulfill their duties.

The vice chairpersons revise weekly assignments and raise common issues at the meetings among Chairperson and vice Chairpersons.

3. When the Chairperson is absent, he/she shall authorize to a vice chairperson to direct the operation of the district People’s Committee and handle the work directly managed by the Chairperson.

In case when one or more vice chairperson is absent, the Chairperson shall take in charge or assign another vice person to deal with the work of the absent vice person. Head of the Office of the district People’s Council and People’s Committee shall timely announce the authorization and work results to the absent Chairperson and vice Chairperson.

4. Members of the district People’s Committee

- Members of the district People’s Committee are delegated by the Chairperson to direct performance of the sectors according to the functions and duties of their agency, bear responsibility before the district People’s Committee, Chairperson and Vice Chairperson managing the agency in implementing the assigned tasks and duties, bear collective responsibility for performance of the district People’s Committee, implement other duties as authorized by the Chairperson and make reports as regulations.

- Timely submit to the district People’s Committee, Chairperson and Vice Chairperson in charge as decentralized to deal with requests of the agencies, units and individuals in the sector of their administration. They shall direct and bear responsibility for the results of citizen reception, dealing with complaints and denunciations, collaborate with communal-level people’s committees to supervise implementation of the related tasks. Any araising problems should be reported to the Chairperson and Vice Chairperson in charge for resolution.

- Closely grasp performance of the unit and make regular reports on the work results (periodically or suddenly) to the Chairperson and Vice Chairperson in charge, report on the work results to the upper-level state management aency as regulations and the district People’s Council as per required.

- Make monthly review on the work results, recommendations and report to the district People’s Committee at the monthly meeting.

5. Based on the real situation, the Chairperson shall consider adjusting the assignments among the Chairperson and Vice Chairpersons to ensure implementation of the common power and duties of the distric People’s Committee. The Chairperson shall direct implementation of the assigned tasks to a vice chairperson if necessary.

* Tasks and duties of the Chairperson and Vice Chairpersons of the district People’s Committees and members of the district People’s Committee

1. Mr Nguyen Dai Luong – Chairman of the district People’s Committee

a) Lead and direct all of the tasks of the district People’s Committee within the functions, duties and power of the district People’s Committee.

b) Direct and manage the following work sectors:

- The master plan (including land use planning, construction and traffic planning), 5-year and annual socio-economic development plans of the district; state budget estimate formulation and implementation; making medium-term and annual public investment plans (including investment programs and list of investment projects); allocation, adjustment and supplementation of the state budget revenue and expenditure and public investment; traffic and transportation development; policies for development of the industrial parks and clusters; policies for investment approval, scale and mechanism of land handover for the non-state budget investment projects; policies for surveying and exploting mineral resources; investment promotion and support; improvement of investment and business climate and construction of e-government.

- Organizational apparatus and public officials; administrative reform; local national defense and military; public security and order; citizen reception; state inspection; combating corruption; management of non-governmental organizations in the locality; going abroad of  public officials under jurisdiction of the Chairperson of the district-leve; People’s committee in accordance with regulations.

- Sudden, important and complicated duties in other sectors, programs, projects and other duties need to be submitted to the provincial-level Party Committee, People’s Council, People’s Committee and district-level Party Committee and People’s Council.

c) Direct the state budget revenue, deal with complaints, denunciations and recommendation of citizens, opinions of the electors, questions of the members of the district People’s Council, the national target programs, emulation and reward.

d) Give opinions on investment policies, investment decision, adjustment to investment policies and decisions for the projects using state budget before the vice chairperson in charge makes decision in the delegated and decentralized sectors.

đ) Directly supervise and manage the agencies: the district Public Security, the district Military Command, the district Inspection, Division of Home Affairs, Division of Finance and Planning, the Management Board of the investment and construction projects and Statistics Sub-department and lead the communes of Van Trung and Viet Tien.

e) Act as the Head of the district Steering Committees for administrative reform and traffic safety, President of the district Emulation and Reward Council, Presicent of the district Military duties and other steering committees and councils of the district in the sectors under management and direction of the Chairperson or as regulated.

g) Keep regular contact with the Standing Board of the district Party Committee, the Executive Committee of the district Party Committee and Standing Committee of the district People’s Council and maintain collaboration between the district People’s Committee and the agencies under the district Party Committee, the district People’s Council, the district People’s Procuracy and the district Fatherland Front Committee.

2. Mr. Than Van Thuan - Vice Chairman of the district People’s Committee

a) Perform the duties as the permanent Vice Chairman of the district People’s Committee

b) Directly supervise and lead the following sectors:

- Agriculture and rural development (including building new-style rural areas, irrigation, development of traditional trade villages, rural industries, “one commune one product” program, dyke management, flood, storm ad natural disaster prevention and fights, search and rescue, fire fighting and forest fire fighting)

Banking and credit activities (including commercial banks, bank for social policies and credit funds), business development, collective economy, private economy, farm economy and household economy, science and technology, culture, sports and tourism (including communication and office culture), education and training, health (including food safety, population and family planning), labor, war invalids and social affairs, social security, ethnic and religous affairs, youth union work, governmental mass mobilization, archive and storage, management of mass associations, salary promotion, emulation and reward and discipline, communication (including the portal and application of information technology), justice and civil status, judgement execution, national defense education, crime and social evil combats, building the movement of the all people protectin the national security, national secret protection and human right protection;

- The national target programs on building new-style rural areas and poverty reduction and other target programs;

- Land recovery and clearance for the projects in the sectors of his management;

- Citizen reception as authorized by the Chairperson, directing and supervising resolution agains complaints, denunciation, recommendations and opinions of the citizens, opinions of the electors, questions of the members of the district People’s Council, implementation of post-inpection issues, participating in handling administrative appeals in the sectors of his management;

c) Directly supervise and lead the agencies: Office of the district People’s Council and People’s Committee, Division of Agriculture and Rural Development, Center for agricultural techniques and services, Viet Yen Irrigation project exploitation factory, Division of Education and Training, Division of Culture and Information, Division of Labor, War Invalids and Social Affairs, Medical Center; Socia Security, Bao Viet Insurance Company, Sub-department of Civil Judgement Execution, Bank for Social Policies, branches and transaction offices of the commercial banks and credit funds in the locality, the Red-cross Society, the communes of Hong Thai and Tang Tien. Besides, he supervises and collaborates with the associations and organizations in the fields of his management suchs as the district Elderly Association, Women’s Union and Farmers’ Association). 

đ) Act as the Head of the district Steering Committee for building new-style rural areas and heads of other steering committees and councils of the district in the fields of his management.

e) Perform as the spokeman of the district People’s Committee who disseminate information to the press agencies.

g) Maintain collaboration between the district People’s Committee and the district Youth Union, Farmers’ Association, Bac Giang University of Agiculture and Forestry, the Vocational Training and Regular Education Center and high schools in the district.

h) Implement other duties as assigned and delegated by Chairperson of the district People’s Committee.

3. Mr. Le Hoang Bach – Vice Chairman of the district People’s Committee

a) Directly supervise and lead the following sectors:

- Industrial sector and handicraft industries, trae, market management, traffic and construction including detailed planning, regional master plan, division, urban order management, water supply and drainage, park, green campus, urban lighting, accommodation development, natural resources and environment, ODA projects (excluding the contents directed by the Chairperson);

- Land pricing, auction of land use right, land, environment, mineral resources, administrative boundary, urban development, residential areas, post and telecommunication, electricity, the national target programs in the sectors of his management, handling obslcles in residential land and land for service purposes;

- Land recovery and clearance for the projects in the district (excluding the projects under management of Mr. Than Van Thuan);

- Citizen reception as authorized by the Chairperson, resolution agains complaints, denunciation, recommendations and opinions of the citizens, opinions of the electors, questions of the members of the district People’s Council, implementation of post-inpection issues, participating in handling administrative appeals in the sectors of his management;

c) Directly supervise and lead the agencies: Division of Economics and Infrastructure, Division of Natural Resources and Environment, the Center for  Land Reserve and industrial cluster development, the traffic order, construction and environment management team, Branch of Land Registration Office, Post Office, the district Telecommunication Station, Viettel, the district Electricity Company, the Market Management Team No 2 and Bich Dong town. Supervise and collaborate with the associations in the sectors of his management.

d) Act as the head of the inter-agency collaboration organizations (steering committees and councils) of the district in the sectors of his management.

đ) Implement other duties as assigned and delegated by Chairperson of the district People’s Committee.

4. Members of the district People’s Committee

a) The Head of the district Public Security: help Chairperson of the district People’s Committee to secure policital security and social safety and order, combat against criminals and legal violations, maintain collaboration to perform the duties as directed by the provincial Public Security Department, implement other duties as assigned by Chairperson of the district People’s Committee. Supervise and take in charge of Quang Chau commune.

b) Chief Commader of the district Military Command: help Chairperson of the district People’s Committee to lead the local national defense and military, search and rescue, maintain collaboration to implement the duties directed by the provincial Military Command, implement other duties as assigned by Chairperson of the district People’s Committee. Supervise and take in charge of Tu Lan commune.

c) Head of the Office of the district People’s Council and People’s Committee: help Chairperson of the district People’s Committee to perform the tasks and duties according to the function and duties of the Office of the district People’s Council and People’s Committee. Implement some duties as follow: contact and meet with press agencies to make timely report to the Chairperson and permanent Vice Chairperson of the district People’s Committee, implement application of information technology, administrative procedure control, application of ISO standards into operation of the the district People’s Committee, direct operation of the one stop shop division and direct the citizen reception division to fulfill their duties. Take in charge of Tang Tien commune.

d) Other members of the district People’s Committee: help Chairperson of the district People’s Committee to lead the sectors and units according to the functions, duties and power of the agencies under the district People’s Committee, implement other duties as assigned by Chairperson of the district People’s Committee and direct the following agencies and units:

- The Head of the Division of Finance and Planning takes in charge of Ninh son commune;

- The Head of the Divison of Economics and Infrastructure takes in charge of Quang Minh commune;

- The Head of the Division of Natural Resources and Enviroment takes in charge of Van Trung commune;

- The Head of the Division of Agriculture and Rural Development takes in charge of Trung Son commune;

- The Head of the Division of Culture and Information takes in charge of Tien son commune;

- The Head of the Division of Health takes in charge of Van Ha commune;

- The Head of the Division of Justice takes in charge of Thuong Lan commune;

- The Head of the Division of Labor, War Invalids and Social Affairs takes in charge of Minh Duc commune;

- The Head of the district Inspection Division takes in charge of Nenh town;

- The Head of the Division of Education and Training takes in charge of Nghia Trung commune;

-  The Head of the Division of Home Affairs takes in charge of Huong Mai commune.
